Policies and Security
Effective Date: November 14, 2014
Last Updated: March 1, 2017. What changed? On March 1, 2017 we updated the Shipping Policy / Delivery Policy to better reflect our current reduced shipping times and to add clarification on shipping times for certain orders.
SECTION 1: SECURITY POLICY
We proudly use Authorize.net for all payments so you can rest assured your payment and personal information is always safe. Our Secure Sockets Layer (SSL) software is the industry standard and among the best software available today for secure commerce transactions. It encrypts all of your personal information, including credit card numbers, name, and address, so that it cannot be read over the internet.
SECTION 2: SHIPPING POLICY / DELIVERY POLICY
*** UPDATED 4/1/2017*** - REFLECTION OF CURRENT ORDER TO SHIP TIMES
Currently standard shipping times for most KITS, QUICK BUILD KITS, BUILDS and other large items are shipping at an estimated rate of 7 - 14 business days or less. SMALLMULTI-ITEM & SINGLE ITEM orders are assigned to their own shipping station and typically go out within 1 - 2 business days of your order.
PLEASE NOTE: COMPLETE CUSTOM BUILDS such as the CUSTOM ULTRA-MATCH BALLISTIC ADVANTAGE & AERO PRECISION 6.5 CREEDMOOR UPPER RECEIVER, and others to be introduced soon are purpose designed and specifically built by hand (with some components actually manufactured by our hands, to meet the highest standards in precise, accurate, real-world durable, dependable functionality and shooter comfort / confidence that is possible with what technology has given us today. These custom and purpose built items can take up to five weeks or longer depending on complexity for us to build (pass 16 rigorous inspections during the build process), Lap, Test, Re-Test and Re-Inspect prior to shipment to you. These items are NOT by any stretch of the imagination 'off the shelf' and the process to build them is demanding and time consuming. PLEASE DO NOT ORDER ONE OF THESE CUSTOM ULTRA-MATCH BUILT ITEMS IF YOU ARE NOT COMPLETELY PREPARED TO WAIT THE FULL FIVE WEEKS OR POSSIBLY LONGER FOR US TO BUILD THE AWESOME INTO IT (THEM). ANYONE POSSESSING ONE RIGHT NOW WILL TELL YOU IT IS WELL WORTH THE WAIT BUT IF YOU ARE THE IMPATIENT TYPE OR THE TIME FRAME JUST DOESN'T FIT WITH YOUR NEEDS OR GOALS PLEASE CALL US PRIOR TO PLACING YOUR ORDER SO THAT WE MAY WORK WITH YOU IN CONSIDERATION OF YOUR NEEDS HOWEVER WE ARE NOT MAGICIANS SO IF IT JUST CANT HAPPEN FOR YOU IT JUST CANT HAPPEN; AT LEAST WE'RE WILLING TO TRY.
We make every effort possible to make sure that any item offered for sale on GroundZeroPrecision.com is in stock, on our shelves and ready to go so your items will ship out within five to seven business days of purchase under normal circumstances, unless marked back-ordered or as part of a pre-order event. We cannot account for situations which are beyond our direct control so we must ask that you allow for events such as weather, strikes, manufacturing issues, quality control issues, political or legislative issues, material shortages or any other event or issue, which falls outside of our direct control or what could reasonably be considered outside of our control, including Acts of God, to possibly delay either shipment, or receipt of any product purchased from GroundZeroPrecision.com or any of its subsidiaries.
Our world class shipping software will determine the most efficient shipping carrier for your order.
The carriers that may be used are: U.S. Postal Service (USPS), United Parcel Service (UPS) or FedEx. APO/FPO and P.O. boxes are accepted.
If you are trying to estimate when a package will be delivered, please note the following:
Credit card authorization and verification must be received prior to processing.
Federal Express and UPS deliveries occur Monday through Friday, excluding holidays.
In order to avoid inconvenience typically a good rule of thumb would be to allow 12 - 14 business days for delivery for most items.
SHIPPING AND HANDLING COSTS:
Free shipment offers and specials will be shipped using the carrier and method chosen by Ground Zero Precision.
Customer shall be liable for return shipment for any item returned where the item is not defective, completely serviceable as designed and where Ground Zero Precision is in no way at fault (example: you changed your mind, or color didn't exactly match your other accessories, etc..)
PLEASE NOTE: Out of state orders WILL NOT be charged sales tax. In state (Texas) orders will be charged 6.25% sales tax plus any associated local taxes up to a combined maximum of 8.25%. Shipping and Handling costs are added to your order and will show in your cart upon checkout.

SECTION 8: LEGAL DISPUTES
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS AND WILL HAVE A SUBSTANTIAL IMPACT ON HOW CLAIMS YOU AND GROUND ZERO PRECISION HAVE AGAINST EACH OTHER ARE RESOLVED.
You and GROUND ZERO PRECISION ("We", "Us") agree that any claim or dispute at law or equity that has arisen or may arise between us relating in any way to or arising out of this or previous versions of the Agreement, your use of or access to the Services, or any products purchased through the Services will be resolved in accordance with the provisions set forth in this Legal Disputes Section.
Legal Disputes: Prohibition of Class and Representative Actions and Non-Individualized Relief.
YOU AND GROUND ZERO PRECISION AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND GROUND ZERO PRECISION AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S OR PARTY'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. ALSO, THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY'S INDIVIDUAL CLAIM(S). ANY RELIEF AWARDED CANNOT AFFECT OTHER USERS.
8-1 Legal Disputes: Mandatory Arbitration
Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, and court review of an arbitration award is very limited. However, an arbitrator can award the same damages and relief on an individual basis that a court can award to an individual. An arbitrator should apply the terms of the Agreement as a court would. All issues are for the arbitrator to decide, except that issues relating to arbitrability, the scope or enforceability of the agreement to arbitrate in this Legal Disputes Section, or the interpretation of the paragraph above entitled "Prohibition of Class and Representative Actions and Non-Individualized Relief", shall be for a court of competent jurisdiction to decide.
You and Ground Zero Precision each agree that any and all disputes or claims that have arisen or that may arise between you and Ground Zero Precision relating in any way to or arising out of this or previous versions of this Agreement, your use of the Site or Services shall be resolved by final and binding arbitration. The arbitration will be conducted by the American Arbitration Association ("AAA") under its rules and procedures, including the AAA's Supplementary Procedures for Consumer-Related Disputes (as applicable), as modified by this Agreement to Arbitrate. The AAA's rules are available at www.adr.org or by calling the AAA at 1-800-778-7879. The use of the word "arbitrator" herein shall not be construed to prohibit more than one arbitrator from presiding over an arbitration, rather the AAA's rules will govern the number of arbitrators that may preside over an arbitration conducted under this agreement to arbitrate in this Legal Disputes Section. Notwithstanding these rules, however, such proceeding shall be governed by the laws of the state of Texas, as set forth in the Section "Choice of Law". Any award in an arbitration initiated under this clause shall be limited to monetary damages and shall include no injunction or direction to any party other than the direction to pay a monetary amount. Further, the arbitrator(s) shall have no authority to award punitive, consequential or other damages not measured by the prevailing party's actual damages in any arbitration initiated under this Legal Disputes Section, except as may be required by statute.
Unless you and we agree otherwise, in the event that the agreement to arbitrate in this Legal Disputes Section is found not to apply to you or to a particular claim or dispute, you agree that any claim or dispute that has arisen or may arise between you and Ground Zero Precision must be resolved exclusively by a state or federal court located in Fannin County, Texas. You and Ground Zero Precision agree to submit to the personal jurisdiction of the courts located within Fannin County, Texas for the purpose of litigating all such claims or disputes.
8-2 Choice of Law:
This Agreement shall in all respects be governed by the laws of the State of Texas and the United States of America, without regard to choice of law provisions. The U.N. Convention on Contracts for the International Sale of Goods (1980) shall not apply to this Agreement.
8-3 No Waiver:
No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term, and Ground Zero Precision's failure to assert any right under this Agreement shall not constitute a waiver of such right or provision.
8-4 Entire Agreement:
If any provision of this Agreement is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Agreement shall remain in full force and effect.
8-6 No Agency:
You and Ground Zero Precision are independent contractors. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
Except as explicitly stated otherwise, any notice required or permitted by this Agreement must be in writing. Any notice to Ground Zero Precision must be given by postal mail to Ground Zero Precision, ATTN: Legal Department, P. O. Box 3, Trenton, Texas 75490. Any notice to you may be given: (1) to the email address you provide to Ground Zero Precision during registration or when your email address changes, in which case notice will be deemed sufficient 24 hours after the email is sent unless the sending party is notified that the email address is invalid; or (2) by certified mail, postage prepaid, return receipt requested, to the last mailing address you provided to Ground Zero Precision, in which case notice will be deemed sufficient three days after the mailing date.
For intellectual property issues, please provide notice as specified in Ground Zero Precision's Copyright and Intellectual Property Policy.
